Motorsports Appeals Panel overturns $50,000 NASCAR fine

DGM Racing has won the appeal of their 75-point penalty and $50,000 fine

On August 4th, DGM Racing has handed a major penalty, noting they broke testing limitations.

The NASCAR Xfinity Series team competed in an SCCA race on the Daytona Road Course. A similar layout to the track being run this weekend.

The Daytona Road Course is the newest addition to the NASCAR schedule. Teams are heading into the race, with no practice on the schedule. They’ll see the layout for the first time during lap 1 of the race.

With the SCCA event in the books, NASCAR considered this a test session as the team reportedly used a car similar to their Xfinity operation. However, testing is banned.

It was an L2 penalty listing violations of 5.1.a and 5.1.d

Per the NASCAR rule book, “Private vehicle testing by any race team, employee, contractor, affiliate, associate, subsidiary, or surrogate is strictly prohibited.”

DGR was hit with a 75 point penalty for driver Alex Labbe. That was in addition to a $50,000 fine for team owner Mario Gosselin.

On Wednesday, the National Motorsports Appeals Panel heard and overturned the penalty from NASCAR. The points will be returned to the team and the fine has been removed.

DGM Racing Statement

They added, “We are thankful for the time and effort put forth by NASCAR in seeking the ultimate truth. A special thank you goes out to our fans and sponsors that never lost faith and supported us throughout this. We must now put our focus back on trying to win races.”

The three person panel consisted of Chuck Deery, Jay Signore and Kevin Whitaker.
