NASCAR has issued a statement
Jay Fabian was the NASCAR Cup Series director. He has stepped away from his role with NASCAR. The reasons were not listed.
Fabian is due to appear in court on September 27th, 2021. The case is held at the Mecklenburg County Court House in the AM.
The court case lists offense code 6210 (Misdemeanor-CRUELTY TO ANIMALS). Additionally, code 6206 (Felony-CRUELTY TO ANIMALS).
NASCAR has stated that multiple people will fill the role Fabian previously held with the company.
“NASCAR takes the situation seriously and will continue to gather information as it becomes available. Jay Fabian will step back from his role until this matter is resolved.”
It’s worth noting that Fabian has not been convicted.
NC Chapter 14: Cruelty to Animals
The following NC laws are listed:
14-360(A) : “If any person shall intentionally overdrive, overload, wound, injure, torment, kill, or deprive of necessary sustenance, or cause or procure to be overdriven, overloaded, wounded, injured, tormented, killed, or deprived of necessary sustenance, any animal, every such offender shall for every such offense be guilty of a Class 1 misdemeanor.”
14-360(B) : “If any person shall maliciously torture, mutilate, maim, cruelly beat, disfigure, poison, or kill, or cause or procure to be tortured, mutilated, maimed, cruelly beaten, disfigured, poisoned, or killed, any animal, every such offender shall for every such offense be guilty of a Class H felony. However, nothing in this section shall be construed to increase the penalty for cockfighting provided for in G.S. 14-362.”
