Earnhardt Federal Court Case – Teresa Earnhardt vs Kerry Earnhardt battle continues over use of term Earnhardt Collection

The Earnhardt federal court case continues over the use of Earnhardt Collection brand name. This is a recurring story that began in 2016. It’s one of those stories that makes my blood boil.

Kerry Earnhardt is still fighting with his step-mom in federal court to use his own name for his home design business. An appeal date has been set for March 10th. Her case basically claims that she has more rights, being married into the Earnhardt name than the people who were actually born into the same name. Teresa Earnhardt was the third wife of NASCAR legend Dale Earnhardt Sr.

However, Teresa Earnhardt still doesn’t want her stepson to use the name Earnhardt Collection. She claims it leads people to believe the homes are from her.

A U.S. Patent and Trademark office ruled that Teresa Earnhardt can’t stop Kerry Earnhardt from using the term ‘Earnhardt Collection’. Kerry and his wife Rene use the brand to sell a collection of homes via Schumacher Homes.

Kerry Earnhardt is the stepson to Teresa Earnhardt. The battle between them continues. Teresa Earnhardt has now filed an appeal of the ruling from the U.S. Patent and Trademark office. The appeal will be heard in Washington.

Teresa Earnhardt claims the term ‘Earnhardt Collection’ is deceiving. She claims it leads some people to believe the homes are from her.

Kelly Earnhardt and VP of JR Motorsports took to twitter to comment on this same story last year, “Hate that my brother & family have to deal w/ this nonsense for over 4 yrs. It’s our name too! We were born w/ it!”
