Today, the Ward family asked for the final hearing to be postponed or canceled due to settlement, Judge says no
Tomorrow, Tony Stewart and the family of Kevin Ward Jr were expected to appear in court for the final time.
The Ward family has asked that the hearing be canceled or postponed. They stated, “they have executed a confidential settlement agreement for which no further action by this court is required.”
Both parties wished for confidentiality in the settlement as they have stated that they have already come to an agreement. They cited a 2004 case in which the courts allowed the dismissal of the hearing.
However, the US District County denied the motion to cancel or postpone the hearing. The judge stated he did not not intend to reveal any confidential information. However, he wanted to make sure a binding settlement agreement has been signed and the dismissal final.
This case stems from an on-track incident at Canandaigua Motorsports Park in August 2014. The two racing drivers were running their dirt sprint cars when an incident led to Kevin Ward Jr being parked against the outside wall.
When Stewart coasted around the following lap, Ward Jr came down the track to show displeasure with the turn of event. In the process, Ward was struck and killed.
The two parties are expected to appear in court for the final time tomorrow after 4 years of repeated hearings. If a settlement on the civil case is still agreed upon in front of the courts, then the case will officially close.
