The postponement was granted at the request of the Ward Family lawyers. Johnny Cargill is representing the Ward family. He’s from the Lanier Law Firm, based in Houston. The Houston area was deeply effected by the path of Hurricane Harvey, which is the reason they asked for the hearing to be postponed.
The lawyers have asked for 3 of 4 claims to be dismissed. The 4th claim is whether or not Tony Stewart acted in an intentional and/or reckless manner in the incident.
