NASCAR accused of discrimination

America First Legal issues complaint to Equal Employment Opportunity Commission

America First Legal has filed a formal complaint to the Equal Employment Opportunity Commission.

Stephen Miller has asked for an investigation into NASCAR and Rev Racing noting, “illegal discrimination against White, male Americans.”

Rev Racing is short for Revolution Racing. The team is designed to bring minority and female drivers into the sport. The team fields machines in the NASCAR Truck Series and ARCA Menards Series. Beyond national series they also enter machines in the late model and legands car divisions.

Kyle Larson, Bubba Wallace and Daniel Suarez has all driven for REV Racing.

America First Legal has noted Title VII of the Civil Rights Act of 1964. They state the diversity driver development program, diversity pit crew development program and the NASCAR diversity internship program are in violation as the title prohibits discrimination based on race and sex.

America First Legal has previously targeted Major League Baseball and others with similar complaints.

AFL Statement

America First Legal issued the following statement via X:

AFL filed a federal civil rights complaint against NASCAR and Rev Racing for instituting a “diversity program” that lavishes drivers and pit crew with career opportunities — but only if they are NOT white and male,” the statement opened.

“Why does NASCAR want to punish white men?”

“Rev Racing is a ‘NASCAR-supported racing team charged with developing female and minority drivers.’ “

“The ‘NASCAR Drive for Diversity Program’ provides ‘training and opportunities for women and minorities in the driver’s seat and on pit crews within the NASCAR industry.’ “

“To implement the ‘Drive for Diversity Program,’ NASCAR and Rev Racing jointly operate a series of programs in violation of Title VII.”

“Prior to September 1, 2023, NASCAR described the program as one in which ‘Top minority and female drivers are provided with coaching, mentoring, and development…while competing with Rev Racing…’ “

“Further, the ‘Driver Eligibility” page explicitly limited admission to “female[s] or member[s] of one or more of the following ethnic minority classifications: American Indian, Alaskan Native or of native/indigenous descent; Asian or Pacific Islander; Black or African-American; Latino or Hispanic.’ “

NASCAR president Steve Phelps speaks on the Drive for Diversity program

This weekend, NASCAR president Steve Phelps spoke on NASCAR diversity program:

“I’m proud of the work that we’ve done in the areas of diversity inclusion to broaden our sport,” NASCAR president Steve Phelps stated.

“Our sport is about welcoming all race fans, right? That’s what we want to do. We are going to continue efforts to have the entire country, the entire world, come to our facilities, watch on television, because it’s about a love for racing.”

“I think our racing and our sport in general, but racing specifically, is a great opportunity for people to come together. That’s what we want to do.”

“We’re going to continue to make sure that we are broadening our fan base, and broadening our fan base across every segment of this population – young, old, black, white, male, female, all of it – because that’s how we’re going to grow.”

“Our job when we wake up in the morning, How can we grow this sport?”

“We’re going to do it with all kinds of programs to meet potential race fans where they are, or existing race fans where they are. I think that’s the responsibility of anyone who works within this sport, certainly those that work in NASCAR.”

This weekend, NASCAR is hosting their championship events. Sunday’s race at Phoenix Raceway will crown the 2023 NASCAR Cup Series champion.
